Methodological Approaches to Public Administration Quality Assessment, Including Regulatory Impact Quality Measurement

The project has been carried out as part of the HSE Program of Fundamental Studies.

This research project was financed by the HSE Program of fundamental studies in 2011.

This research aims to be a methodological and data-collecting foundation for the launch of a new, HSE-branded index for quality of public administration. This index will include the component named “quality of regulation and implementation of regulatory impact assessment (RIA)”.

The study was developed in two directions:

  • Analysis and description of a systematic approach to regulatory impact quality measurement and assessment (here the main research topic was the system of the analytical tools used by carrying out the RIA, and also a set of necessary activities for the development of the institute of RIA).
  • Analysis of public administration quality in Russia from the point of view of as many as possible ratings/indexes used worldwide and the elaboration of strategy to improve Russia’s position in these indexes and ratings (here the research topic is the combination of existing ratings and indexes).

The research objectives are the following:

  • Elaboration of public administration performance benchmarking a system based on analysis of a combination of different indexes and ratings.
  • Identification and description of the most effective approaches to the use of various analytical tools within the RIA (with a transition from the centralized process of assessment to the analysis of draft laws by regulatory bodies).

Among the main data sources for this project were:

-  RF government statistics;
-  The methodological descriptions and data arrays for 65 major both Russian and worldwide indexes of public administration and public management quality;
-  Our own ratings for subfederal bodies’ implementation of the modern PA technologies;
-  Russian Legal databases;
-  Interviews devoted to the concept and the implementation of “smart regulation”).

All interviews in the National German Council for better regulation were managed by our foreign academic partners –prof. Dr. K. Bizer (Goettingen university), and professors Dr. Gizela Faerber and Dr. Sabine Kuhlmann at the German institute of the public administration Speyer.

The project results delivered in 2011 are:

a) for the principles of improvement of the Russian position within the ratings of public administration quality:

- An academic report on the position of Russia in 65 international indexes of public administration quality and governance practices (all indexes were analyzed and classified into several groups in order to be more manageable and representative);
- An econometric analysis of the cause-and-effect chain between (1) the technologies used by government bodies, (2) quality of public administration and (3) quality of life and socio-economic development. The analysis was based on empirical data for Russian sub-federal units from 2005 to 2010. It has been proved that the speed and scope of modern public administration technologies’ implementation within government bodies has a positive influence on the quality and speed of socio-economic development of a certain sub-federal area (region) with a lag of 4 to 6 years;
- Background work and preparations have been made for the launch of a new, HSE-branded index for quality of public administration. This index will, among other components, include the component named “quality of regulation and implementation of regulatory impact assessment (RIA)”.

А) for the methodology of RIA and its implementation in Russia:

- A full description of stage-by-stage procedure for carrying out public consultations depending on specific features of analyzed regulation (plus the potential role of business panels as sources of attraction for stakeholders to public consultations and its application in Russia was reasoned);
- Classification of general types of costs and benefits which can be scrutinized within RIA process;
- Stage-by-stage procedure of the RIA statements’ quality analysis in Russia was elaborated (with the possibility to change the path of analysis depending on specific features of analyzed regulation, on time available and on actual budget restrictions);
- Comparative analysis of two possible ways to improve the use of RIA in Russian legislative drafting with pro’s and con’s of each of them and all the necessary implementation algorithms;
Reasons and proofs for the establishment of Better Regulation Executive Council (National council for regulation improvement) as the agency of the RF Ministry of Economic Development.
