The International Scientific and Practical Conference «Information Sovereignty of the Russian Federation: Problems of Legal Provision in the Conditions of Modern Challenges and Threats»

Leading Research Fellow of the International Laboratory of Digital Transformation in Public Administration of the HSE University Evgeny Diskin made a presentation on the topic «Internet Platform and Digital Sovereignty» at the International Scientific and Practical Conference «Information Sovereignty of the Russian Federation: Problems of Legal Provision in the Conditions of Modern Challenges and Threats», which took place at the Moscow State Law University named after O.E. Kutafin (MGUA), on November 22, 2023.

During his presentation, Evgeny Diskin noted a number of significant enforcement problems and gaps in legislation. He has described a phenomenon that had arisen with regard to the recognition of Meta Inc. as an extremist organization, because it had been perhaps the only example where the product of an organization that had obtained such status could be used. The speaker noted that the prerequisites for such a solution were formed in one situation, but the situation is becoming continuous. He drew the attention of colleagues to the fact that in legal science there is no search for possible solutions to this situation.

In addition, Evgeny Diskin gave a brief overview of the application of problems related to the use of recommendatory technologies. In particular, the Federal Law "On Information, Information Technologies and Information Protection" of 27.07.2006 N 149-FZ was amended to regulate recommendatory technologies. Nevertheless, noting the positive aspects of the Act, criticism was expressed regarding the effectiveness of the Act in terms of the protection of users' rights. The legal mechanism is not described, which would allow to fix violations in the application of recommendatory algorithms.
